These Terms of Service ("Terms") govern your access to and use of AltFrame at altframe.app ("Service"), operated by Mozart Labs LLC ("Company," "we," "our," or "us"), a company based in Austin, Texas.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

AltFrame is an AI-powered SaaS platform that processes images and generates alt text, titles, captions, and other metadata for web accessibility and SEO purposes. The Service is offered on a subscription basis with usage limits defined by your selected plan.

2. Account Registration

You must create an account to access the Service. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at support@altframe.ai if you suspect unauthorized access.

3. Subscription and Billing

• Subscriptions are billed monthly or annually depending on your selected plan.
• All fees are non-refundable except as required by law or stated in our refund policy.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Credits (usage allowances) reset at the start of each billing period and do not carry over to future periods on the Free plan. Paid plans may include credit rollover up to plan-defined limits.
• Overage usage beyond your plan credits is billed at the per-credit rate specified for your plan.

4. Acceptable Use

You agree not to use the Service to:

• Upload images that are illegal, infringe third-party intellectual property, depict child sexual abuse material, or violate applicable laws
• Attempt to reverse-engineer, scrape, or extract our AI models
• Circumvent rate limits, access controls, or billing mechanisms
• Resell the Service without our express written consent
• Use the Service in ways that could harm, disable, or impair it or other users' access

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Intellectual Property

You retain ownership of all images and content you upload to the Service. You grant us a limited, non-exclusive license to process your content solely to provide the Service.

Generated outputs (alt text, titles, captions, descriptions) are provided to you and may be used for any lawful purpose. We make no claim to ownership of generated outputs.

AltFrame, our trademarks, and all related intellectual property remain the exclusive property of Mozart Labs LLC.

6. API Usage

API access is subject to rate limits defined by your plan. We may throttle or suspend API access if usage patterns negatively impact the Service for other users. API keys are personal credentials and must not be shared publicly.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED OUTPUTS WILL MEET YOUR REQUIREMENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOZART LABS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Mozart Labs LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account for violations of these Terms. Upon termination, your access to the Service will cease and your data will be retained for 30 days before permanent deletion, except where required by law.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Travis County, Texas.

12. Changes to Terms

We may modify these Terms at any time. We will provide 30 days' notice for material changes via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance.
